MARCH TO SCRAP BILL C-49:


Bill C-49 is a federal government piece of legislation which purports to be against "human trafficking" but is actually a not so thinly disguised anti-refugee bill made up in response to the arrival of the Tamil "boat people" on the west coast. Extensive information on what the bill means and contains can be seen at the website of the Vancouver No One Is Illegal group. This same group is calling for a demonstration this Saturday to demand that the bill be dropped. Here is the call.

Join No One is Illegal in a rally and march to call for the immediate release of detained Tamil asylum seekers, and an end to racist and restrictive refugee policies, including the recently tabled Bill C-49.

Surviving a dangerous journey, 492 Tamil refugees, including women and children, arrived in BC after fleeing war and persecution in Sri Lanka. Three months later, the vast majority of the refugees remain in jails, facing endless hearings that have revealed the clear incompetency, deliberate negligence, and racism of the system.

Canadian government officials and media outlets continue to perpetuate false and dehumanizing stereotypes of 'illegals', 'terrorists', and so-called queue-jumpers. This fear-mongering is just another tactic used to disguise the racist policies that define Canada’s immigration and refugee system.

Public Safety Minister Vic Toews and Minister of Censorship and Deportation Jason Kenney, have recently introduced Bill C49 under the banner of combating “human smuggling” and deterring the arrival of future boats. Bill C49 would give the Minister the power to single out for special punishment refugees who are suspected of having fled their country by means of smugglers. These punishments are harsh and inhumane. Asylum seekers suspected of using a smuggler will be subject to mandatory detention for the first year after arrival, with no chance of review, including for children. They also will not have the right to appeal a negative refugee decision. In addition, they will be prohibited from obtaining permanent residency for a period of five years after obtaining refugee status. This means these refugees will be held in limbo, not be allowed to leave the country nor sponsor their family members, effectively separating them from their families for a period of time well beyond those five years.

This is a shameful piece of legislation. Refugees are forced from their homes in emergency situations due to human rights abuses committed during wars, military occupations, or persecution against a minority group. We cannot expect refugees to wait for Canada to select them from overseas. We must understand that they undertake long and dangerous journeys to protect their lives and the lives of their families. According to the 1951 UN Convention on Refugees, to which Canada is a party, there are no penalties on refugees who arrive without pre-authorization and irregularly.

No One is Illegal-Vancouver asserts the basic human right to safety, mobility, and protection. It is well known that Tamils in Sri Lanka are fleeing military atrocities and mass displacement. The only crime the migrants have committed is transgressing this imposed settler-colonial border. We encourage you to join us in rejecting repressive, racist, and exclusionary ideologies and policies, and instead encourage compassion, solidarity, respect for life, and justice for all refugees.

LABOUR SAYS BILL C-49 ANTI-REFUGEE:
The following news story comes from the Public Service Alliance of Canada (PSAC-AFPC). It's about the new Conservative Bill C-49 which purports to be against "human trafficking". In actual fact as one BQ member of Parliament said, it should be called the Tamil Bill. You can read more of the Parliamentary debate on this Bill here at Open Parliament. Molly has repeatedly blogged on the situation of the Tamil "boat people", now into their third month of captivity in BC where they expected safety. In particular I have mentioned the solidarity efforts of No One Is Illegal Vancouver. Now others are coming onboard. Here's the story from the PSAC.

Human Smuggling Legislation Violates Refugee Rights
The government's bill to prevent human smuggling does not meet Canada's domestic and international human rights and refugee protection obligations said the Public Service Alliance of Canada. The government should tackle the problems of criminal smuggling in ways that do not punish refugees.

Bill C-49, the Preventing Human Smugglers from Abusing Canada's Immigration System Act tabled on October 21st, violates the rights of refugees and migrants. By restricting the rights of refugees who arrive in Canada as part of a group that the government designates to be a “human smuggling event,” the Bill creates two classes of refugees.

The restrictions include harsh powers of mandatory detention of those designated persons, including children, for one year without independent review; denial of the right to appeal a negative decision to the Refugee Board's Refugee Appeal Division; prohibition to apply for permanent resident status for five years; and serious limitations on freedom of movement and family unity.

If Bill C-49 becomes law, Canada would be violating its legal obligations under the Canadian Charter of Rights and Freedoms, the 1951 Refugee Convention, the International Covenant on Civil and Political Rights, and the Convention on the Rights of the Child.

“Measures to address criminal smuggling must ensure that refugees' and migrants' rights relying on smugglers are protected,” said John Gordon, National President of PSAC. “People at risk of torture and who fear for their lives may turn to smugglers out of desperation, regardless of penalization.”

Detention of refugee claimants should only be used as a last resort and must be for reasons that are established in international law, such as demonstrated concerns about security. Detention should never be used as a means of deterring other refugees who are seeking safety.

The legislation also gives the government the power to arrest and detain any non-citizen, including a permanent resident, based on a mere suspicion of criminality. It appears that this provision is not limited to designated persons or refugee claimants, and would apply to all non-citizens. Although the bill deals with refugees, it is also an attack on the rights of newcomers – and long-term residents.

The PSAC believes workers dealing with refugees should have clear guidelines and tools on how to do their job. In addition, it is important that Canada work with other countries to take action to combat human smuggling as it involves serious human rights violations against vulnerable migrants. However, policies to combat human smuggling must respect the rights of refugees seeking asylum in Canada.

This legislation is part of a continuing trend by the Harper government to disregard Canada's human rights obligations.

WEEKLY NOISE DEMONSTRATION FOR THE TAMIL DETAINEES:
Meanwhile out on the west coast the Tamil "boat people" continue to be detained as the federal government makes a glacially slow decision on their fate, more likely than not trying to find a way to ship them back to Sri Lanka with the minimum possible fuss. As has been reported before on this blog Canadian citizens in Vancouver have organized weekly demonstrations in solidarity with the Tamils, demanding that they be allowed to stay in Canada. They call them "noise demonstrations". Here is the latest announcement from the immigrant solidarity group No One Is Illegal Vancouver calling for more noise in the upcoming two weekends.

When the ship first neared Esquimault, territories of the Songhees First Nation, it was immediately boarded by the Armed Forces, Border Services, and RCMP. Families are now being separated, with many children being taken by the Ministry of Child and Family Development. The refugees now face the threat of incarceration and eventual deportation.

Canadian government officials and media outlets are perpetuating false and dehumanizing stereotypes of 'illegals', 'terrorists', and so-called queue-jumpers. The earlier arrival of 76 Tamil migrants on Ocean Lady was similarly sensationalized. This deliberately created hysteria appeals to prejudices of refugees as undesirable. Well-known neo-Nazis, like Paul Fromm and the Aryan Guard, also known as the Canada First Immigration Reform Committee, are openly organizing rallies for the ship to be sent back.

This fear-mongering is just another tactic used to disguise the racist policies that define Canada’s immigration and refugee system. The Canadian government was recently forced to apologize for its “keep Canada white” measures, such as the Komagata Maru incident. Yet Minister of Censorship and Deportation Jason Kenney continues to increase detentions and deportation of refugees and undocumented migrants, while bringing in more temporary exploitable migrant labour. Public Safety Minister Vic Toews recently declared that Cabinet is drafting new policies to clamp down on migrants and “make this country less welcoming for future shipments of human cargo.”

6) Always take a minute to write letters to the editor and comment on news stories - make a difference in public discourse! Reinforce your support for the migrants and condemn irresponsible reporting including repeating unsubstantiated lies and giving white supremacists like Paul Fromm a platform. All letters must be short (100 words), include name, mailing address and daytime phone number of the writer; state “Letter to the Editor” in subject; and content should be in the body of the email.

7) Take your own initiative. This issue is not just the Tamil communities’ or for migrant justice organizers. The growing racist backlash that is taking root should concern all of us. Think of creative ways to disrupt this xenophobic climate (do a banner drop, host a community picnic, take some friends postering, organize a forum or press conference, distribute anti-racist zines, take action at the prison).

8) Consider inviting a speaker to your next meeting. Email noii-van@resist.ca and we would be happy to attend or suggest speakers, as well as provide educational materials.

9) Have your organization, traditional council, union, community group, or artist collective write a short public statement of support for the Tamil migrants. Please email us a copy at noii-van@resist.ca .
