Arizona Lawmakers Target Public Workers' Unions

Labor unions plan to rally in front of the Arizona State Capitol on Thursday afternoon to protest four bills quickly moving through the state Legislature that could make last year's Wisconsin labor laws look modest by comparison.

Three of the four bills restrict the way unions collect dues and the way workers get paid for union activities. The fourth bans collective bargaining between governments and government workers: state and local. Unlike Wisconsin, it affects all government employees, including police and firefighters.

"It seems as though those employees or at least the unions that represent them don't care what the burden is on the taxpayer as long as they get theirs," says state Sen. Rick Murphy, a Republican who is sponsoring the bills.

Murphy says collective bargaining lets public workers put themselves ahead of the public they are working for.

Nick Dranias of the Phoenix-based Goldwater Institute, a libertarian/conservative think tank that helped Murphy write the bills, says public-sector workers in Arizona make about 6 percent more in salary and benefits than their private-sector counterparts.

"You're not in government, you know, to collect a fat paycheck," Dranias says. "You're in government to serve. And if you get paid reasonably, that's nice, but the moment you feel the need to organize collectively and create laws like collective-bargaining laws that give you special privileges to negotiate and extract compensation not seen in the private sector, you've gone too far."

Arizona is also different from Wisconsin in that it's a right-to-work state: No one can be forced to join a union. So unions in Arizona already have less clout. Still, 80 percent of police in the state choose to belong to a union.

Brian Livingston, who represents the Arizona Police Association, which is fighting the bills, says police and firefighters typically get paid less in salary, but he acknowledges that they negotiate better benefits and retirement plans. Livingston says police deserve it.

"By the time we retire, we know that most of us will not live beyond what the average private citizen does," he says. "And I'm speaking specifically about public safety, the rigors of our occupation, the hazards of our occupation take a lifelong toll on our longevity."

Democrats in the Arizona Legislature are outnumbered by Republicans 2-to-1 in the House and by more in the Senate.

Senate Minority Leader David Schapira says he is appalled by the bills.

"These bills are clearly the most anti-worker, anti-middle class, anti-union bills in the history of the country," he says.

Schapira says the bills are purely political. They're being considered, he says, because union leaders tend to support Democrats over Republicans.

"These are people that the Tea Party leadership at the State Capitol in Arizona disagree with, and so they're punishing them and that's the purpose of these pieces of legislation," he says.

Murphy, the bills' sponsor, acknowledges that public worker labor unions are a political problem for him. The elected officials labor leaders are negotiating with, he says, are afraid to give in to unions for fear of political reprisal.

"When the unions are the ones who are disproportionately influencing those elected officials, the elected officials are very rarely on the side of the taxpayers in those negotiations," he says.

The swiftness of this new attempt at cutting the power of public worker unions took labor leaders by surprise. The bills were introduced just last week, passed through committee and are ready for a full Senate vote.

PROTEST DRACONIAN ARIZONA ANTI-IMMIGRANT BILL



The following appeal to protest the recent anti-immigrant bill passed in the state of Arizona comes from the United Farm Workers Union. This bill will make the state the first in the union to declare that being an illegal immigrant is actually a crime and not just an administrative offense. It also mandates that police can stop and demand documentation from anyone they have a suspicion of being an illegal immigrant. This translates, of course, into "being brown". Sounds something like creeping totalitarianism to me. In addition the bill contains provisions that actually reach the level of bizarre. It will allow lawsuits against the police should any parties feel that they aren't enforcing the law vigorously. No direct injury need be adduced. I challenge anyone to come up with another example of such a provision anywhere in the world. Then there is another section that makes it a crime to knowingly drive an illegal immigrant. There's one exception. Those "driving illegal immigrants to church" are exempt from prosecution. I kid you not. Only in America ! Here's the appeal.

Chilling new AZ law could be signed Friday. Take Action Now
Can you help us? An appalling bill with chilling repercussions, especially for Arizona Latinos, can reach AZ Governor Jan Brewer's (R ) desk by Friday.

According to a Los Angeles Times front page story, "The bill, known as SB 1070, makes it a misdemeanor to lack proper immigration paperwork in Arizona. It also requires police officers, if they form a 'reasonable suspicion' that someone is an illegal immigrant, to determine the person's immigration status...Immigrant rights groups say it amounts to a police state." Alessandra Soler Meetze, president of the American Civil Liberties Union of Arizona, said, "A lot of U.S. citizens are going to be swept up in the application of this law for something as simple as having an accent and leaving their wallet at home."

This means that anyone, even you, who walks in Arizona can be charged with a misdemeanor if you're not carrying identification to prove you are a legal resident.

The bill has just passed the Arizona House and could be on the governor's desk by Friday. Please send contact Gov. Brewer today and tell her not to sign the bill into law.

HELP FIGHT ARIZONA BILL TO BAN ETHNIC STUDENT GROUPS:
The following is a rather unusual appeal from the United Farm Workers in the USA. It seems that there is some sort of bizarre rider to a bill now before the Arizona legislature that would ban students in that state from forming groups based on race. This was tacked on to a "homeland security" bill ???, as explained below. The bill is actually an ill-disguised attempt to prevent students from minority ethnic groups from organizing to promote their interests, and it may not be so strange to see the UFW opposed to this sneaky little trick iof one considers the high percentage of Mexicans in the UFW.
Now, whatever you may think of such groups, whether they are a good thing, a bad thing or sometimes good and sometimes bad, it can hardly be argued that the proposed bill is not an infringement on the basic right of association. It is something that would be a total non-starter up here in the frozen north. A rather nasty and underhanded one at that. The UFW appeal follows below. Help fight Ariz. bill to ban ethnic student groups like MEChA, Black Business Students Assoc.
Multiculturalism is a basic American concept. We value the beliefs, traditions, customs, arts, history and folklore of the diverse cultures reflected throughout our nation. All this is being put at risk in Arizona, where last week the Appropriations Committee passed an amendment to a routine homeland security bill, SB 1108 that would prohibit students at the state’s public universities and community colleges from organizing groups based on race (ie: groups such as MEChA, the Black Business Students Association, Native Americans United, etc.)

Please take action today. This bill could reach the Arizona House floor as early as this week.

According to newspaper reports, Rep. John Kavanagh, (R-Scottsdale), a supporter of the measure called these campus organizations, "'self-defeating' and 'self-destructive' for students."
Self-defeating? Multiculturalism doesn't limit students. It gives them pride in who they are and enhances their being fuller people by fostering the concept of America being the land of opportunity. As Cesar Chavez said, "Preservation of one's culture doesn’t mean contempt for others'."

These student groups are like any other school club or fraternity. They bring students together so they can achieve academic success. They offer a place to meet, make friends and support one another. Their goal is to help students succeed. For example, the members of the University of Arizona's MEChA chapter visit high schools to encourage students to attend college. They hold events and fundraisers to spread the message that education is the key to success.

The bill goes one step further. It also would ban public schools or colleges from including race-based classes or school sponsored activities. Officially the language says it would ban any activity "deemed contradictory to the values of American democracy or Western civilization." However, the language is so broad, who knows what could be prohibited? Certainly Chicano studies, African-American studies & other ethnic studies programs would be put at risk.

Studies show that students who learn about their race and culture have a lower drop-out rate. In truth, if this bill passes it could cause a huge set back in our educational system.
Please take immediate action. If you live in Arizona, e-mail your representatives immediately as well as the Speaker of the House. If you live outside Arizona, please e-mail the Arizona Speaker of the House today and let him know the eyes of the nation are on Arizona.
